1. Definitions

A domain is an area of the Internet hierarchical name space, which is denoted by a unique domain name, served by a set of Domain Name Servers (DNS), and administered autonomously by an Administrator. Each registered domain name is assigned a single Administrator.

The Registry is the central database of the RU domain, which contains information on the registered domain names and their Administrators, and other information required for the domain registration.

A Registrar is a juristic person that provides services of domain name registration and ensures delivery of the necessary information to the Registry.

An Applicant is a natural or juristic person that requests a service of domain name registration and enters into an appropriate agreement with a Registrar.

Domain name registration means entry of the information about a domain name and its Administrator on the Registry by a Registrar following an Applicant's Application. A domain name is considered registered from the moment the information is entered on the Registry. The registration term, during which the information on a domain name is stored on the Registry, is one year. The registration of a domain can be repeatedly renewed for another year.

The Administrator of a domain is the person in whose name the domain is registered. The Administrator of a domain defines the rules and order of using the domain name, is responsible for selecting the domain name and for possible infringement of the rights of any third party in connection with the selection and use of the domain name, and is liable for the costs of such infringements.

The Administration of a domain means definition, by the Administrator, of the rules and order of using the domain name, and management and technical support of the domain operation.

Registration termination (domain name vacation) is removal of the information on a domain name and its Administrator from the Registry.

Domain delegation is placement and storage of the information about a domain name and its domain name servers (DNS servers) on the root DNS servers of the RU domain, which enables the operation of the domain on the Internet. The delegation of a domain is only possible during the registration term of the domain.

An Application (Order) is a request of an Applicant to a Registrar which is made on a form given by the Registrar and contains the information required for the registration (renewing the registration) of a domain name.

The Personal account of a Customer's Agreement is a record of the Customer's payments to RU-NIC as a Registrar, as well as the Customer's expenses for services provided by RU-NIC. Any payment made by a Customer is added to the Personal account of their Agreement after the money has been credited to RU-NIC's bank account and RU-NIC has received from the bank a document identifying the payment.

 

2. General

2.1. RU-NIC provides services of domain name registration under the authority of the contract No-83 dated January 10, 2001, between RU-NIC and RIPN. RU-NIC is a Registrar authorized by RIPN to register domains, and a Customer is an Applicant and the Administrator of a domain.

2.2. RU-NIC provides services to a Customer that has entered into a Service Agreement with RU-NIC. Entering into an Agreement is preceded by the procedure of registering the Customer on RU-NIC's database. The Customer is responsible for selecting and registering individual administrative and technical passwords during the registration on the database, for securing their confidentiality, and for all actions that involve using the passwords.

2.3. The Customer agrees that any information the Customer provides by filling in applications and other documents, including those in an electronic form, under sections of these documents marked as "open", will be placed by RU-NIC on the search engines and will be open to the general public. A list of the information that is bound to be published and published with the Customer's consent, can be found at RU-NIC's Web server.

2.4. An Order for a service indicates that the Customer agrees to pay for the service at the price effective at the date the processing of the Order begins.

2.5. A service is provided to a Customer based on the Agreement, so long as there is an Order for the service and all applicable requirements of this Regulation are met.

2.6. A service of registration of a domain in the RU domain is deemed provided from the moment the information on the domain and its Administrator is entered on the Registry.

2.7. A service of renewing the registration of a domain in the RU domain is deemed provided from the moment the information on the renewal is entered on the Registry.

2.8. The form of any official letter is set by RU-NIC. The letters should be sent to the following address:

3. Conditions of domain registration and delegation

3.1. Conditions of domain registration

A domain cannot be registered in any of the following cases:

3.1.1. The domain name has already been registered.
3.1.2. The domain name does not meet any of the following requirements:

- the domain name must consist of more than one symbol, begin and end with a letter of the Latin alphabet or a digit; the interjacent symbols may be letters, digits, or hyphens;
- the domain name must not contain words that are inconsistent with the public interest, principles of humanity, and public morals (in particular, obscenities and appeals of violent nature that offend human dignity or religious feelings etc.).

3.2. Conditions of domain delegation

3.2.1. A domain may only be delegated after receiving positive results of a validity check on the domain name servers (primary and secondary DNS servers) that, as specified by the Customer, hold the configuration files of the domain.

At least two of the DNS servers specified by the Customer must be on different IP networks (on different Class C networks in customary terms) and have reliable connection to the Internet. A "reliable connection" implies that the total time for which the server is not connected to the Internet does not exceed two hours a day. These servers must be maintained in conformity with the requirements of the international standards RFC-1032, RFC-1033, RFC-1034, and RFC-1591. If positive results of the validity check on the domain name servers are not received within 4 (four) days, the check is ceased. The procedure of testing the DNS servers can be initiated again by the Customer using RU-NIC's Web interface.

3.2.2. The information on domain name servers must correspond to the current state of the network.

3.2.3. In the case of any breach of the provisions in paragraphs 3.2.1 and 3.2.2 of this Regulation, RU-NIC may stop the delegation of a domain at any time during the registration term. The delegation can only be resumed after the breach is corrected.

 

4. Processing of Orders for domain registration

4.1. Processing rules

4.1.1. Customers place Orders for new services using RU-NIC's Web interface. The forms for the placement of Orders can be found at RU-NIC's Web server: http://www.nic.ru

4.1.2. An Order for a new service can be cancelled by the Customer at RU-NIC's Web server in the section "Manage your account" (link "View and change data") before the processing of the Order starts.

4.1.3. An order is processed if the Customer has signed an Agreement with RU-NIC and the funds in the Personal account of the Agreement are sufficient to pay for all services of the Order.

4.1.4. If there are several complete Orders for the same service from different Customers, such Orders are processed on a first-come basis.

4.1.5. Different Orders for new services from a single Customer are processed on a first-come basis. The sequence in which the Orders are processed can be changed at RU-NIC's Web server in the section "Manage your account" (link "View and change data").

4.1.6. During the period of the reservation (blockage) of money in the Personal account of an Agreement for a renewal of a service, an Order for this renewal has priority in processing over any Orders for new services placed by the same Customer.

4.1.7. RU-NIC examines Orders for the compliance with the conditions set forth in this Regulation. During the period of examination of an Order RU-NIC may request the Customer to provide additional information required for the examination.

4.1.8. RU-NIC's decision to register a domain or to refuse the registration will be based on a reason provided for in this Regulation.

4.1.9. If there is any doubt, for a reason specified in this Regulation, whether the registration of a domain is possible, RU-NIC may suspend the registration of the domain for a period of 15 (fifteen) days. After that RU-NIC must register the domain or issue a reasoned refusal of the registration.

4.1.10. In there is a reason for the refusal of registration RU-NIC will inform the Customer about the impossibility of the domain being registered and the reason for this refusal.

4.1.11. A decision about registration, refusal of registration, or registration suspension is sent to the Customer within 2 (two) working days from the moment the processing of the Order begins.

4.2. Special provisions

4.2.1. All data provided by a Customer at the signing of the Agreement and registration on RU-NIC's database must be factual. If a Customer submits false information the registration may be terminated (the domain vacated).

4.2.2. If there is any doubt about the authenticity of data provided by a Customer for the registration of a domain, RU-NIC may demand confirmation of the data and/or request additional information during the entire term of the registration. Such requests are sent via e-mail to the Customer's contact address specified in the Agreement.

4.2.3. If the previously provided data is not confirmed and/or additional information not provided within 10 calendar days from the moment of the first request, RU-NIC may suspend the delegation of the Customer's domains. The delegation of the domains can be resumed within 3 (three) working days after receiving the required information.

If the required information is not provided within 20 (twenty) calendar days from the moment of suspending the delegation the registration of the domains is terminated.

4.2.4. The registration of a domain is terminated before the expiry of the registration term in the following cases:

a) by reason of the Administrator's written request;
b) according to paragraph 4.2.3 of this Regulation;
c) by reason of an effective court order:

- which finds that the administration of the domain by its Administrator breaches the plaintiff's rights;
- and/or prohibits the use of a designation belonging to or licensed to the plaintiff in the domain name.

In such cases, the person whose rights the court has found infringed is given priority in registration of the vacated domain. To make use of the prerogative, the person should send a written request to a Registrar's address not later than 30 (thirty) calendar days after the court order becomes effective.

 

5. Domain registration renewal

5.1. Renewing the registration of a domain ensures storage of the information about the domain on the Registry for a period of one year.

5.2. RU-NIC suspends the delegation of a domain if the registration of the domain is not renewed by the Customer before the registration term ends. If the registration is renewed before its termination RU-NIC resumes the delegation of the domain within 3 (three) working days.

5.3. RU-NIC terminates the registration of a domain if it is not renewed by the Customer within 30 (thirty) calendar days from the date the registration term of the domain ends.

5.4. Renewal procedure

5.4.1. An Order for renewing the registration of a domain is placed by the Customer automatically two months prior to the end of the registration term. At the same time, RU-NIC gives the Customer notice of the necessity to renew the registration at the contact e-mail addresses specified in the Customer's Agreement.

5.4.2. The registration of a domain will be renewed by RU-NIC if the funds in the Personal account of the Customer's Agreement are sufficient to pay for the service of renewal and if the Customer has not cancelled the renewal.

5.4.3. A Customer may cancel a renewal of the registration of a domain at RU-NIC's Web server in the section "Manage your account" (link "Service renewal") before the service of renewal is provided. After that the Customer will still be able to consent to the renewal at any time before the termination of the registration.

5.4.4. The fact that a Customer has not cancelled a renewal of the registration of a domain confirms the Customer's consent to the provision of the service of renewal and to the debiting of the Agreement's Personal account for the renewal. The Personal account of a Customer's Agreement is debited according to Section 6 of this Regulation.

 

6. Payment for services. Principles of debiting the Personal account of an Agreement

6.1. The cost of RU-NIC's services is specified in the Service Agreement.

6.2. Invoicing

6.2.1. RU-NIC will invoice a Customer upon receiving an appropriate request from the Customer. The request for an invoice is made by the Customer at RU-NIC's Web server in the section "Manage your account". On condition that the Customer has signed an Agreement with RU-NIC, the original of the invoice will then be sent to the Customer by post:

- within 3 (three) working days after RU-NIC receives the Customer's request for the invoice - if the Customer is a juristic person;

- as requested by the Customer - if the Customer is a natural person.

A copy of an invoice can be printed by the Customer at RU-NIC's Web server in the section "Manage your account".

6.2.2. A Customer has to put the number of their Agreement with RU-NIC in the "Payment Subject" section of any payment document prepared by the Customer.

6.3. Payment for services from the Personal account of a Customer's Agreement

6.3.1. RU-NIC keeps a record of a Customer's payments and the services provided to the Customer, according to the actual prices of these services, as the Personal account of the Customer's Agreement. Any payment made by a Customer is added to the Personal account of their Agreement after the money has been credited to RU-NIC's bank account and RU-NIC has received from the bank a document identifying the payment.

A Customer can access the information on the Personal account of their Agreement at RU-NIC's Web server in the section "Manage your account" (link "Account balance").

6.3.2. RU-NIC provides a Customer with a service after reserving (blocking) sufficient money in the Personal account of the Customer's Agreement. Money that is blocked for a service cannot be used to pay for another service.

If money is blocked to pay for renewing a service, the Customer can remove the blockage by cancelling the renewal. Money may be unblocked before it is debited from the Agreement's Personal account. A renewal of a service can be cancelled at RU-NIC's Web server in the section "Manage your account" (link "Service renewal").

6.3.3. Reservation of money in the Personal account of a Customer's Agreement

6.3.3.1. The funds for several new services of domain registration ordered by the same Customer are blocked in the sequence in which the Orders for these services are placed.

The sequence in which Orders for new services are processed can be changed by the Customer at RU-NIC's Web server in the section "Manage your account" (link "View and change data"). If a Customer changes the sequence in which the Orders for new services are processed, the funds for the new services will be blocked in this new sequence.

6.3.3.2. The funds for renewing several services of domain registration ordered by the same Customer are blocked in the sequence in which the terms of these services expire (the funds for a service whose term expires earlier are blocked earlier).

6.3.3.3. The funds for a new service may only be blocked after the reservation of money for renewing all the Customer's services whose renewal requires such reservation immediately and has not been cancelled by the Customer (reservation of money for renewing any existing service has priority over the reservation of money for any new service).

The period of the reservation of money for a service, as well as the rules of this reservation, are specified in the Regulation governing the service.

6.3.3.4. The funds for renewing a service of domain registration are blocked in the Personal account of the Customer's Agreement not earlier than 8 (eight) calendar days before the term of the service ends, if the Customer has not cancelled the renewal.

6.3.4. The funds for renewing a service of domain registration are debited from the Personal account of the Customer's Agreement not earlier than 1 (one) calendar day before the term of the service ends, if the Customer has not cancelled the renewal.

6.4. Upon termination of an Agreement, or if a Customer provides reasons why the Customer cannot use RU-NIC's services, the remainder of the Customer's money is returned to the Customer by bank transfer to the Customer's account at any bank in the Russian Federation. RU-NIC will take all actions that are necessary for the return within 7 (seven) working days from the date RU-NIC receives the Customer's written request with full information on the payee's bank account. The remainder of a Customer's money is the money in the Personal account of the Customer's Agreement after all services the Customer has used since the signing of the Agreement are paid.

 

7. Modifying parameters of a domain registration service. Changing Administrator's data

7.1. Parameters of a domain registration service - technical data which determine the operation of the domain.

Administrator's data - identification and contact data of the Administrator of a domain, which are entered on the Registry when the domain is registered.

7.2. The data of an Administrator or the parameters of a domain registration service can only be modified after the Order for registration of the domain is processed.

7.3. Modifying parameters of a domain registration service

Any modifications are made at RU-NIC's Web server by:

- going to the "Manage your account" section,
- selecting "View and change data" in the "Services" menu,
- locating the service whose parameters are being modified,
- clicking on the "edit" link,
- making necessary changes,
- and saving the changes.

7.4. Changing Administrator's data on the Registry

The data of an Administrator on the Registry are changed by modifying the data in the Administrator's Agreement with RU-NIC.

7.4.1. Changing a Customer's contact data in the Agreement

The contact data of a Customer are: telephone number, fax number, e-mail addresses, postal address. Any modifications are initiated at RU-NIC's Web server by:

- going to the "Manage your account" section,
- selecting "Edit data" in the "Agreement" menu,
- making necessary changes,
- and saving the changes.

After a Customer initiates such modifications at RU-NIC's Web server, the Customer's contact data in the Agreement will be modified within 2 (two) working days.

After a Customer's contact data in the Agreement with RU-NIC are modified, the Customer's contact data on the Registry will be changed within 24 hours.

7.4.2. Changing a Customer's identification data in the Agreement

The identification data of a Customer are: company name, legal address, individual taxpayer number, first name and surname, passport data, date of birth. Identification data are modified through an official letter from the Customer to RU-NIC. The form of the letter is given at RU-NIC's Web server. The letters should be sent to the following address:

After RU-NIC receives such a letter from a Customer, the Customer's identification data in the Agreement will be modified within 2 (two) working days.

After a Customer's identification data in the Agreement with RU-NIC are modified, the Customer's identification data on the Registry will be changed within 24 hours.

 

8. Transfer of a domain to another person

8.1. A domain may be transferred to another juristic or natural person that has signed a Service Agreement with RU-NIC on the basis of an official letter from the Administrator to RU-NIC. The form of the letter is given at RU-NIC's Web server.

8.2. If RU-NIC receives an official letter from the Administrator of a domain requesting a transfer of the domain to another person that has signed a Service Agreement with RU-NIC, as well as an official letter from this person confirming the intention to become the Administrator of the domain, RU-NIC will transfer the domain within 2 (two) working days and give the previous and new Administrators of the domain an appropriate notice.

 

9. Transfer to another Registrar

9.1. The Administrator of a domain may transfer the responsibility to enter information about the domain name and its Administrator on the Registry to a new Registrar not earlier than 60 (sixty) calendar days after the registration of the domain.

9.2. The responsibility to enter information about a domain name and its Administrator on the the Registry can be transferred to RU-NIC from another Registrar through an official letter of the Administrator to RU-NIC. The form of the letter is given at RU-NIC's Web server.

9.3. The responsibility to enter information about a domain name and its Administrator on the the Registry can be transferred from RU-NIC to a new Registrar through an official letter of the Administrator to RU-NIC. The form of the letter is given at RU-NIC's Web server.

9.4. If RU-NIC receives from the Administrator of a domain an official letter notifying RU-NIC that the responsibility to enter information about the domain name and its Administrator on the Registry is being transferred from RU-NIC to another Registrar, RU-NIC will take all actions that are necessary for the transfer within 2 (two) working days and give the Administrator an appropriate notice at the contact e-mail addresses specified in the Agreement.

 

10. Transfer from RU-NIC to RU-NIC's Partner. Changing the Partner. Transfer from a Partner to RU-NIC

10.1. A Customer may receive RU-NIC's services from RU-NIC's Partner.

10.2. The responsibilities to provide a Customer with RU-NIC's services of domain registration and registration renewal, and to collect payments for these services can be transferred

- from RU-NIC to RU-NIC's Partner
- from RU-NIC's Partner to another RU-NIC's Partner
- from RU-NIC's Partner to RU-NIC

if the Customer fulfils the following conditions:

- the Customer has entered into an agreement with the person that assumes the above responsibilities;
- the Customer has sent an official letter notifying RU-NIC that the responsibilities are being transferred; the form of the letter is given at RU-NIC's Web server.

10.3. If RU-NIC receives such an official letter from a Customer, RU-NIC will transfer the responsibilities specified in paragraph 10.2 within 2 (two) working days and give the Customer an appropriate notice at the contact e-mail addresses specified in the Agreement.

10.4. From the moment the responsibilities specified in paragraph 10.2 are transferred from RU-NIC to another person, the contractual relations between RU-NIC and the Customer are temporarily ceased. They may be resumed if the Customer makes a special application to RU-NIC on a form provided by RU-NIC.
